Zoning Law - You Can Beat City Hall

In 2003 Mr. Kuvin was cited for parking his personal use pick-up truck in the drive of in front of his Coral Gables home. Mr. Kuvin, at the time a paralegal, researched the issue and found cases where similar laws had been held to be unconstitutional.

 

Mr. Kuvin informed the City Attorney of his research and provided her with copies of the cases. The City refused to update the City zoning codes to reflect the change in law and Mr. Kuvin was forced to file suit to protect his rights. The case made its way through the court system and in 2005 Mr. Kuvin lost in the trial court, but he refused to give up.

 

As a third year law school student Mr. Kuvin wrote the appeal brief and argued his case in front of a three judge panel at the Third District Court of Appeal in Miami. The court published a 48 page opinion in August of 2007 which over-turned the trial court and held the City's parking ordinances to be unconstitutional.
